Group Health Plans sponsored by State
and local governmental employers must generally comply with Federal law
requirements in Title XXVII of the Public Health Service Act. However, these
employers are permitted to elect to exempt a plan (opt out) from the requirement
listed below for any part of the plan that is “self-funded” by the employer,
rather than provided through a health insurance policy. Maricopa County has
elected to exempt the Maricopa County Benefits Plan from the following
against having benefits for mental health and substance use disorders be
subject to more restrictions than apply to medical and surgical benefits
covered by the plan.
The exemption from these
Federal requirements has been in effect since the Maricopa County Plan Year
2010-11, beginning July 1, 2010 through June 30, 2011 and has been renewed for
PY 2011-12, PY 2012-13, PY
2013-14, PY 2014-15, PY 2015-16, PY 2016-17, and PY 2017-18. The election may
be renewed for subsequent plan years.
