Options to Appeal a Plan Review Decision

If a customer disagrees with a Department decision regarding a code interpretation during the plan review and construction process, the following options are available.
  1. Discuss your concern with the Department's plan reviewer or inspector. Contact the Pool Plan Review Program to obtain contact information.
  2. You may request a clarification from the Department of its interpretation or application of a statute, ordinance, regulation, delegation agreement or authorized substantive policy statement as provided in A.R.S. §11-1609. Contact us by in by email or telephone, or in person or mail.
  3. A variance is a waiver issued by the Department that authorizes a deviation from a requirement of the Maricopa County Environmental Health Code (MCEHC) for the construction or modification of a pool or spa, if, in the opinion of the Department, a health hazard, safety or nuisance will not result from the deviation.   4. You have the right to appeal the denial of an application. To do so, you must file a written request for the appeal within 15 working days of receipt of denial. The request for appeal shall identify the applicant, the business and the action being appealed, and provide a concise statement of the reasons for the appeal. A request for the appeal is filed upon receipt by the Maricopa County Environmental Services Division (MCESD) Director. Upon proper filing of a request for appeal, MCESD will serve a notice of hearing.
