The use and disposal of wastewater and reclaimed water within Maricopa County is governed by the rules and regulations of the Maricopa County Environmental Health Code. Chapter 2, Section I, Regulation 2, Subsection B of the code requires that: "Sewage, reclaimed wastewater, refuse, human excreta, or other wastes shall not be placed or deposited into any waters of the County or upon or under any land within the County, except as approved by the Department and in accordance with the provisions of the Arizona Administrative Code, Title 18, Chapter 9, Section C305 including all revisions, technical corrections, and supplements published as of November 12, 2005."
With the exception of a wastewater collection system operating with a Capacity, Management, Operation and Maintenance (CMOM) Permit, all releases of wastewater or reclaimed water to non-permitted areas are considered to be spills by the Maricopa County Environmental Services Department (MCESD).
If a wastewater or reclaimed water spill occurs it must be reported to the Maricopa County Environmental Services Department by the operator of the wastewater or reclaimed water system/facility and clean-up and remediation efforts must be implemented.
