ARS 12-1602 allows a
school district to designate The County Superintendent of Schools as the
chief disbursing office for their school district. Fifty-three of fifty-eight School Districts
in Maricopa County have designated this office as the Chief Disbursing Officer
for all garnishment of wages upon any of their employees. Our office processed
over 1100 garnishments in the past school year. We are responsible for following
all Federal and State laws from the moment of service through the closure
of the writ of garnishment, tax levy, or default student loan. **
Service for writs of garnishment for school district employees
within Maricopa County must be served upon The Maricopa County Superintendent of Schools
Office, with the following exceptions of Higley, Paradise Valley,
East Valley of Technology, Palo Verde, and Cave Creek employees. The Garnishee and Statutory
agent are The Maricopa County Superintendent of Schools office, on the next
line you must include name of the particular school district. There is no
master list available to us with all school employees so this is imperative.

Remember that service must be upon our office for these
employees and will not be received at the school district with the exceptions
of Higley, Paradise Valley, East Valley of Technology, Palo Verde, and Cave
Creek employees.
Federal and State writs of garnishments can be court
ordered deductions of an employee's wages to satisfy outstanding debts from
creditors. Garnishments can also be a defaulted federal student loan and tax
levies. There are three types of tax levies: Internal Revenue Service, Arizona Department
of Revenue, and Arizona Department of Economic Security.
** Default Student Loans and Tax Levies must be
served to the individual school district. **
The Maricopa County School Superintendent has no authority to modify or
release a garnishment/levy. All decisions and adjustments must be made
by the creditor. Any changes must be written and faxed to (602) 372-8589.
