A variance is a waiver issued by the Department that authorizes a deviation from a requirement of the Maricopa County Environmental Health Code (MCEHC) for the construction or modification of a pool or spa, if, in the opinion of the Department, a health hazard, safety or nuisance will not result from the deviation. You have the right to appeal the denial of an application. To do so, you must file a written request for the appeal within 15 working days of receipt of denial. The request for appeal shall identify the applicant, the business and the action being appealed, and provide a concise statement of the reasons for the appeal. A request for the appeal is filed upon receipt by the Maricopa County Environmental Services Division (MCESD) Director. Upon proper filing of a request for appeal, MCESD will serve a notice of hearing.
